Marco Legal

- SPANISH PRIVATE SECURITY ACT 23/1992

Art. 19 in the Act states that : "private investigators are  hereby authorized:

a) to obtain and contribute information and evidence, conduct and private activities or  factual action at the  request of individual subjects and/or legal entity.

b) to initiate investigations of punishable deeds only by motion of the legal representative before the court.

c) to render surveillance services at  sites such as state fairs, hotels, exhibitions and other of the sort."


- STATUTORY REGULATION IN PRIVATE SECURITY (domestic law; R.D. 2364/1994)

Art. 101:

2.The terms "private conduct and action" will apply to  dubious private activities that might affect the interests of others, particularly in the sphere of economy, labour, financial and commercial damage as well as personal, familial or social harm. They will no apply should such behaviour is sustained in the person4s own residence or in private rooms,


- SPANISH ACT ON LAWSUIT (1/2000)

Art. 265.1.5 in the Act notes that "Every lawsuit or reply must be registered along with.... the reports drafted by fully authorized private investigators  on those facts or relevant evidence to the cause in littigation. In the event that would not suffice as proof, the investigator involved will be summoned to testify.


- DATA PROTECTION

Private investigators alone are exempt from the obligation of informing to the party under investigation about the actions in course (Resolutions E-00128/2004 and E-00778/2005; Spanish Data Protection Agency).
